This website is operated by Mizzen and Main LLC (“Mizzen+Main”). Throughout the site, the terms “we”, “us” and “our” refer to Mizzen+Main. Mizzen+Main offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“terms and conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These terms and conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

By accessing or using any part of the site, you agree to be bound by these terms and conditions. Our store is hosted by an ecommerce company. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including payment card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. 

We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. 

We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

7. Discount Prices and Promotions

All prices, discounts and promotions posted or otherwise made available at the time of purchase are subject to change without notice to the extent permitted by applicable law.  We may, from time to time, offer promotions or other discounts on purchases.  We reserve the right to suspend any such promotions, update product information and change prices at any time without notice.  Furthermore, we reserve the right to change, limit, refuse or cancel any order you place with us at our sole discretion.  If we change or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address and/or phone number provided at the time the order was made.

Refund available up to 30 days after the date of delivery. If past the 30 days, returns have up to 45 days to receive store credit or be exchanged for another item

Promotions are only valid during the duration of the promo. Promotions cannot be combined with any other offers or discounts of any kind unless specified. Promotions are valid on regular price merchandise only and do not apply to last chance items unless specified and under no conditions apply to gift cards, gift boxes, Vessel bags, ties, beanies, 2-pack polos, Yeti products, or officially licensed collegiate styles. Items can be returned or exchanged only for the amount paid at the time of purchase. If necessary, we are able to process price matching on purchases made within 14 days of the start of the sale.

Lead Generation Campaigns and Promotions

From time to time, Mizzen+Main may offer lead generation campaigns, including but not limited to email or SMS opt-ins, product quizzes, sweepstakes, giveaways, and promotional pop-ups (“Lead Gen Campaigns”). By submitting your information in connection with any Lead Gen Campaign, you agree to receive promotional emails or text messages from Mizzen+Main in accordance with your communication preferences and our Privacy Policy.

Participation in a Lead Gen Campaign is voluntary. Any personal information you submit through these campaigns will be handled in accordance with our Privacy Policy and may be used to personalize your experience, recommend products, and provide marketing communications via email, SMS, or targeted ads.

You may opt out of marketing communications at any time by following the unsubscribe instructions in our emails or replying “STOP” to SMS messages. Participation is not required to make a purchase.

8. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. Similarly, we reserve the right to cancel any order that we have reason to believe, in our sole discretion, is made fraudulently or for other illicit purposes. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and payment card numbers and expiration dates, so that we can complete your transactions and contact you as needed. 

We are not liable for orders that are unable to be retrieved, post-delivery, because an incorrect address was provided.

9. Payment 

Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before our acceptance of an order. By entering into any transaction, you represent, warrant and covenant that: (1) all information you provide is true, correct and complete (including, without limitation, your payment card information and billing address); (2) any payment card transactions submitted by you are authorized; (3) charges incurred by you will be honored by your credit card company and/or bank, as applicable; (4) you will pay charges incurred by you at the posted prices, including where applicable, all applicable taxes, if any, and any additional fees or costs (e.g., where you elect to insure a shipment); and (5) you are the legal holder of any credit card or payment account used to enter into any transaction.

If, in our sole discretion, we determine that: (i) your means of payment is not valid, (ii) a transaction is not authorized, (iii) your means of payment cannot be processed or verified at the time of any charge, (iv) a charge is disputed for any reason other than failure by us to deliver the item(s) purchased by you, (v) you have abused or misused promotions or promotion codes, as applicable, or (vi) you have otherwise used the website or Services to enter into an improper transaction, we reserve the right to immediately terminate any pending transactions, suspend your access to the Site, and terminate all of our obligations hereunder. 

Payment Processing

By agreeing to these terms and conditions, you acknowledge and consent that the payment processing services for products and/or services purchased from us will be provided by a third-party payment processer.

10.  Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these terms and conditions. Some lead generation features offered on our site may be provided through third-party platforms or plugins. Your use of these features is subject to the terms and privacy practices of those providers.

All trademarks, trade names, trade dress, logos and service marks (collectively, the “Trademarks”) appearing on this website and/or in our store are the property of their respective owners, including, in some instances, us and/or our partner companies.  Nothing contained on this website, in our store, the Services or these Terms serves to grant you, by implication or otherwise, a license or right to use any of the Trademarks or copyrights owned by us or by any third party.  

You may not use, modify, create derivative works of, copy, redistribute, reproduce, publish, transmit, display, commercialize, or in any other way exploit any content or material from this website, our store, or the Services without express written permission from us and, if applicable, the respective copyright owner.  You acknowledge and agree that you do not acquire any ownership rights by accessing or using this website, our store, and/or the Services.

You may, from time to time, send certain specific submissions at our request (for example contest entries) or without a request from us, send creative ideas, suggestions, feedback, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “Comments”). Moreover, we welcome our customers to share photos, videos, images, text, reviews or other content regarding their purchase and enjoyment of the Services (collectively, “User Content”). 

You hereby grant to us and our affiliates, the royalty-free, perpetual, irrevocable, worldwide, transferable, non-exclusive right and license to use, reproduce, modify, adapt, publish, perform, share, re-post, translate, create derivate works of, and display your Comments or User Content, without payment, royalties, or other consideration to you, in connection with (1) the operation of the website or our store, (2) providing you the Services, and (3) for our business purposes, including, without limitation, promotion, advertising or marketing of Mizzen+Main, in any form, medium or technology now known or later developed[, or for use with and training of any machine learning and artificial intelligence models we are using or may in the future develop or deploy].

You acknowledge and agree that we may preserve your Comments and User Content, and may also disclose your Comments and User Content if required to do so by law or if there is certain belief that such preservation or disclosure is reasonably necessary to: (A) comply with legal process; (B) enforce these terms and conditions; (C) respond to claims that the Comment or User Content violates the rights of third-parties; or (D) protect the rights, property, or personal safety of Mizzen+Main, its affiliates, partners or other third parties, and the public.    

By submitting your contact information or other user content through interactive tools or forms, you consent to receive marketing communications from Mizzen+Main, subject to your preferences and applicable law.

Any personal information collected or processed through this website or our store, including through forms, pop-ups, or interactive features, is governed by our Privacy Policy.

15.  Shipping

Domestic Shipping

A purchase qualifies for free shipping if the cart total is equal to, or greater than $150, after discounts have been applied and before tax.

Expedited and Priority (3-Day, 2-Day, Next Day) orders placed after 11am CT will be shipped the next business day. Saturday delivery not available. We do not ship to P.O. Boxes.

International Shipping 

International orders are subject to duties and taxes dependent on the country. 

Shipping Protection

You may elect to purchase optional coverage (i.e., insurance) to ensure the secure delivery of products purchased from our store. Such coverage may apply to limited products and may be subject to additional terms and conditions.   

16.  Returns

Customers are responsible for the cost of returning items to us. The original shipping fees, customs duties, and taxes, as applicable, are non-refundable. You have 30 days from the date of purchase to request a return or a refund for a domestic order. You have 45 days from the date of purchase to request a return for a store credit for an international order. Exchanges are currently unavailable for international orders. Returns requested after this period may not be accepted.

Returns & Exchanges

We offer domestic returns and exchanges for items purchased at mizzenandmain.com or at a Mizzen+Main store. You have 30 days to receive a full refund to your original form of payment or 45 days to receive store credit or exchange for another item. Last Chance items (markdowns) are eligible for exchange or store credit only. Items should be unwashed and unworn to be eligible for credit of any kind.

Instant Exchanges must be initiated within 14 days of your order delivery date. After 14 days, Instant Exchanges will no longer be available, and you may still process a standard return or exchange if eligible. If the original item from an Instant Exchange is not returned within the required time frame, your payment method may be charged for the replacement item.

Please note, for orders requiring a refund, a $5 restocking fee will be deducted from the refund to cover processing costs. Returns for exchange or store credit will not be subjected to this fee.

Simply visit returns.mizzenandmain.com and follow the instructions to initiate your return or exchange. If returning multiple orders, each must be sent back separately with corresponding return labels to guarantee timely and accurate refunds are processed.

Please note that gift cards are ineligible for return or refund.

Restocking Fee

Unless the product is defective or the return is a direct result of a Mizzen+Main error, we may charge a restocking fee of $5, plus any applicable sales tax, which would be applied through a total reduced refund or credit. 

17.  Collegiate Licensing Collection

Please note that Collegiate Collection items are embroidered and will require up to 12 business days before they are shipped. These items are eligible for our standard return policy, which allows you to return them within 30 days for a refund or within 45 days for an exchange or store credit. Due to licensing fees, discount codes cannot be applied to Collegiate Collection items.

18.  Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

19.  Prohibited Uses

In addition to other prohibitions as set forth in the terms and conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. In no case shall Mizzen+Main, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Mizzen+Main and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these terms and conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

22. Severability

In the event that any provision of these terms and conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms and conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

23. Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These terms and conditions are effective unless and until terminated by either you or us. You may terminate these terms and conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these terms and conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.
