Price Adjustments

Mizzen+Main will honor a one-time price adjustment on full-price purchases made within 14 days of a sale or promotional event. Price adjustments are not available on Last Chance or final sale items, items purchased with a promotional code, or items that have since sold out of your size. Lead Generation Campaigns and Promotions

From time to time, Mizzen+Main may offer lead generation campaigns, including but not limited to email or SMS opt-ins, product quizzes, sweepstakes, giveaways, and promotional pop-ups. By submitting your information in connection with any Lead Gen Campaign, you agree to receive promotional emails or text messages from Mizzen+Main in accordance with your communication preferences and our Privacy Policy. 8. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to refuse, cancel, or terminate orders at any time on reasonable grounds, including if there is an ongoing dispute concerning payment of a prior order or if we suspect, in our sole discretion, that you have engaged in fraudulent activity or otherwise violated these Terms.

We also reserve the right to block or suspend access to our website and Services for any account we determine, in our sole discretion, to be in violation of these Terms or to be compromising the integrity of our platform. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. We are not liable for orders that are unable to be retrieved, post-delivery, because an incorrect address was provided.

Initiating payment disputes in bad faith, or habitually disputing charges for reasons other than a failure by Mizzen+Main to deliver the item(s) purchased, is considered a violation of these Terms. We reserve the right to provide transaction records and related correspondence to payment processors and financial institutions in the event of any disputed transaction.

9. Payment

Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order. By entering into any transaction, you represent, warrant and covenant that: (1) all information you provide is true, correct and complete; (2) any payment card transactions submitted by you are authorized; (3) charges incurred by you will be honored by your credit card company and/or bank; (4) you will pay charges incurred by you at the posted prices, including all applicable taxes and any additional fees; and (5) you are the legal holder of any credit card or payment account used to enter into any transaction.

If, in our sole discretion, we determine that your means of payment is not valid, a transaction is not authorized, a charge is disputed for reasons other than our failure to deliver, you have abused promotions or promotion codes, or you have otherwise entered into an improper transaction, we reserve the right to immediately terminate any pending transactions, suspend your access to the Site, and terminate all of our obligations hereunder.

By agreeing to these terms and conditions, you acknowledge and consent that the payment processing services for products and/or services purchased from us will be provided by a third-party payment processor.

16. Shipping

Domestic Shipping

Express and Overnight orders placed after 11am CT will be shipped the next business day. Saturday delivery not available. We do not ship to P.O. Boxes.

International Shipping

International orders are subject to duties and taxes dependent on the country.

Shipping Protection

You may elect to purchase optional coverage to ensure the secure delivery of products purchased from our store. Such coverage may apply to limited products and may be subject to additional terms and conditions.

17. Returns

Customers are responsible for the cost of returning items to us. The original shipping fees, customs duties, and taxes, as applicable, are non-refundable. You have 30 days from the date of purchase to request a return or refund for a domestic order. You have 45 days from the date of purchase to request a return for store credit for an international order. Returns and exchanges will be processed within 7 business days upon arrival to allow time for inspection. Exchanges are currently unavailable for international orders. Returns requested after this period may not be accepted.

Returns and Exchanges

We offer domestic returns and exchanges for items purchased at mizzenandmain.com or at a Mizzen+Main store. You have 30 days to receive a full refund to your original form of payment or 45 days to receive store credit or exchange for another item. Last Chance items (markdowns) are eligible for exchange or store credit only. Items must be unwashed and unworn with all tags attached to be eligible for credit of any kind. Returns and exchanges will be processed within 7 business days upon arrival to allow time for inspection.

Instant Exchanges must be initiated within 14 days of your order delivery date. After 14 days, Instant Exchanges will no longer be available, and you may still process a standard return or exchange if eligible. If the original item from an Instant Exchange is not returned within the required time frame, your payment method may be charged for the replacement item.

For orders requiring a refund, a $5 restocking fee will be deducted from the refund to cover processing costs. Returns for exchange or store credit will not be subject to this fee.

Simply visit returns.mizzenandmain.com and follow the instructions to initiate your return or exchange. If returning multiple orders, each must be sent back separately with corresponding return labels to guarantee timely and accurate refunds are processed.

Gift cards are ineligible for return or refund.

Restocking Fee

Unless the product is defective or the return is a direct result of a Mizzen+Main error, we may charge a restocking fee of $5, plus any applicable sales tax, which will be reflected as a reduced refund or credit.

Returns on Discounted and Bundle Orders

If your order included a discount code, promotional offer, or bundle pricing, the discount applied to your order will be distributed proportionally across all eligible items at the time of purchase. Refunds on partial returns from discounted or bundle orders will reflect the prorated value of the returned item after discount distribution, not the full retail price of the individual item. The restocking fee, where applicable, will be calculated based on the discounted amount paid.

Order Review

Orders flagged for suspected fraudulent activity are subject to a mandatory manual review before any refund, return, or exchange is processed. Standard return processing timelines do not apply during this review period. We aim to complete all reviews within 10 business days of the flag being raised. Mizzen+Main will not issue a refund or credit until the review is complete.

Returns Eligibility

Mizzen+Main reserves the right to refuse or deny any return or exchange at our sole discretion, including in cases where we have reason to believe the return does not meet our policy requirements. Returns and exchanges are subject to review and approval.

Policy Acceptance

By initiating a return or exchange through our returns portal, you confirm that you have read, understand, and agree to the Mizzen+Main return policy and Terms of Service, available at mizzenandmain.com/terms-of-service.

18. Collegiate Licensing Collection

Collegiate Collection items are embroidered and will require up to 12 business days before they are shipped. These items are eligible for our standard return policy, which allows you to return them within 30 days for a refund or within 45 days for an exchange or store credit. Due to licensing fees, discount codes cannot be applied to Collegiate Collection items.

19. Force Majeure

Mizzen+Main shall not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control. This includes but is not limited to acts of God, natural disasters, pandemics or public health emergencies, war or civil unrest, government actions or restrictions, carrier or logistics disruptions, supplier failures, labor disputes, power outages, or internet or platform outages.

In the event of a force majeure, we will make reasonable efforts to notify affected customers and resume normal operations as quickly as possible. If an order cannot be fulfilled due to a force majeure event, we will offer a full refund or, where possible, an alternative fulfillment timeline.

20. Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice.

In no case shall Mizzen+Main, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

24. Dispute Resolution

Please read this section carefully. It affects your rights by requiring arbitration of disputes rather than court proceedings or jury trials.

Informal Resolution

Before filing any formal dispute, you agree to contact us at info@mizzenandmain.com and provide a written description of the dispute, your name, and the relief requested. We will attempt to resolve the dispute informally within 30 days of receiving your notice. If we are unable to resolve the dispute informally, either party may proceed to binding arbitration as described below.

Binding Arbitration

Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Dallas, Texas, before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between Mizzen+Main and you individually. To the fullest extent permitted by law, (a) no arbitration or proceeding shall be joined with any other, (b) there is no right or authority for any dispute to be arbitrated or resolved on a class action basis or to utilize class action procedures, and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or other persons.

Exceptions

Notwithstanding the foregoing, either party may bring an individual action in small claims court. Either party may also seek emergency injunctive relief in any court of competent jurisdiction where necessary to prevent irreparable harm pending the conclusion of any arbitration.

25. Governing Law and Jurisdiction

These terms and conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration under Section 24, you consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Dallas County, Texas. If you are accessing the Services from outside the United States, you are responsible for compliance with all applicable local laws. Mizzen+Main makes no representation that the Services are appropriate or available for use in locations outside the United States.
