This Privacy Policy describes how Mizzen+Main (“we,” “us,” or “our”) collects, processes, uses, and discloses the personal information we collect from or about you when you access, use or engage with our website (www.mizzenandmain.com) and any of our other websites (our “Sites”), mobile applications or other platforms managed by us, or any other online product or service where this Privacy Policy is displayed (collectively, our “Online Services”), as well as when you communicate or otherwise interact directly with us online or offline, including in our physical stores (collectively with Online Services, our “Services”).

This section is intended as a quick-reference to summarize our data handling practices, which are explained in more detail throughout this Privacy Policy. 

  • Our Collection of Personal Information. We collect this personal information in various ways, including:

Directly from You: We collect certain information directly from you, including when you make an online or in-store purchase, create an online account, sign up to receive our emails, arrange for a delivery, return a purchase, participate in a sweepstakes, contest, promotion, lead generation campaign (such as quizzes, pop-up forms, gated content, or email/SMS opt-ins), or survey, provide comments or other feedback about our Services, or provide a review of your purchase(s) (including text, photos, or other content you provide to us). We also collect personal information when you correspond with us, communicate with us via third party social media sites, request customer support or otherwise interact with us.

Automatically From Your Engagement With Our Services: We automatically collect certain information about you when you access, use, or engage with our Online Services, including: information about your device(s), internet service provider, the type of browser you use, access times, pages viewed, links you click on our Online Services, your activities while visiting or engaging our Online Services, your IP address, the referring link through which you accessed our Online Services, and other information about how you use the Online Services. We use Google Analytics to understand how visitors engage with our Sites. If you do not want Google Analytics to be used in your browser, you can install the Google Analytics browser add-on.

From Third Parties: We may receive your personal information from our service providers and other third party sources, including:

  • Identity Management Services. Mizzen+Main offers discounts to a number of groups, such as current members of the military and veterans, students, and others.  We partner with certain third-party identity management services (e.g., ID.me) to confirm eligibility for these discounts.  We may collect personal information associated with your “wallet” or other profile on that third-party platform. Our access to any such personal information is dependent on that identity management service provider’s policies and other legal terms, and your privacy settings on that third-party platform. 

  • Social Media Platforms. If you decide to access or post information on third-party social media sites (e.g., Instagram, Facebook, X) or grant us access to your profile on a third-party social media service, we may collect personal information associated with your third-party account, such as name, email address, activities, or contacts. The data we receive is dependent on that third party’s policies and other legal terms, and your privacy settings on that third-party site.

  • Your Employer. We offer a “Corporate Orders” program. If you are identified as the contact person for that program, we may collect certain personal information about you, such as your company, job title, and business contact information (email and telephone number) from your employer or an agent of your employer. 

  • Lead Generation Platforms. If you interact with lead generation experiences powered by third-party tools embedded in our Online Services, those platforms may collect and process information on our behalf. We recommend reviewing their terms and privacy policies as well.

  • Other Third Parties. We conduct “Refer a Friend” and other leads generating initiatives through which your friends and others may provide us with your email address. 

Use of Personal Information

We and third parties working on our behalf may use or disclose the personal information we collect for one or more of the following business purposes:

  • To provide and maintain our Services and otherwise to fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information as part of purchasing a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns. If you submit a story or review (including photos) about your experience with Mizzen+Main and/or our products and services, we may post that story or review on our Sites without identifying you by name or address.

  • To create, maintain, customize, and secure your account with us, including maintaining our rewards program and other offerings.

  • To process your purchases, transactions, and payments and prevent transactional fraud.

  • To contact you, provide you with support, respond to your requests and inquiries, including to investigate and address your concerns and monitor and improve our responses, and otherwise to communicate with you, depending on your preferences, via email, SMS text, phone call, and/or other means.

  • To analyze your use of and interaction with our Online Services in order to improve the same, personalize your experience, develop new services or offerings, provide recommendations, inform you of our products and Services, and those of our affiliates and partners that may be of interest to you, and otherwise to better understand your needs and to track trends and usage of our Services.

  • To operate lead generation campaigns, such as product quizzes, email/SMS sign-ups, or pop-up forms, and to communicate with you about promotions, recommendations, or product updates that may be relevant based on the information you provide.

  • To market and advertise to you, including, depending on your preferences and whether you have provided consent, sending promotional communications via email, SMS text message, phone call, or other means.  

  • For testing, research, analysis, and product development, including to develop and improve our Site, products, and Services.

  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; to enforce our rights, carry out our obligations, and otherwise to protect our rights, property or safety or that of others.

  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred. For instance, if our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

  • As otherwise described to you when collecting your personal information, for any other purpose for which you provide consent, or as otherwise required or permitted by law

Disclosure of Personal Information

We may disclose your personal information as permitted or required by law for various purposes, with the following categories of third parties:

  • Subsidiaries, affiliates, business partners, and other third parties, in order to fulfill the purposes set forth above.

  • Service providers, vendors, contractors, and developers that assist us in operating our business, developing and providing the Services, or otherwise fulfilling the purposes set forth above. This may include the use of certain third-party tools deployed on our Online Services with which you may engage, including chatbots or other artificial intelligence technologies used to generate responses.  

  • Third-party internet advertising networks and other third parties, including for promotional purposes, to serve or display advertising, and otherwise to fulfill the purposes set forth above.

  • Successor(s) in interest or other third parties, to evaluate proposed transactions, including a sale, reorganization, merger, acquisition, or other change of control.

We may also share your personal information with third party data cooperatives for our commercial purposes as well as for the commercial purposes of those cooperatives. We will not share your contact information or consent to be contacted via SMS text for marketing or promotional purposes with third parties, affiliates, or subsidiaries.

We may also disclose your personal Information to other third parties:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce or apply our Terms of Service and other agreements, including for billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Mizzen+Main, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.

  • For any other purpose with your consent.

In the preceding 12 months, Mizzen+Main has disclosed the following categories of personal information for a business purpose to the third parties identified above: (A) Identifiers, (B) California Customer Records personal information categories, (D) Commercial information, (F) Internet or other similar network activity, (G) Geolocation data, (H) Sensory data, (K) Inferences drawn from other personal information, (L) Equipment information.

We do not knowingly “sell” or “share” the personal information of individuals under 16 years of age. 

We do not use or disclose sensitive personal information for any purpose other than those permitted under the CCPA. 

Retention of Your Information

We will retain your personal information for only as long as is reasonably necessary to fulfill the purpose(s) for which it was collected, as set out in this Privacy Policy or any other notice provided to you at the time your personal information is collected, or as otherwise required to meet our legal obligations.

Your Privacy Rights and Choices

Subject to certain exceptions under applicable law, and the jurisdiction in which you reside, you have rights with respect to your personal information, including the right to:

  • Access, know about, or confirm the processing of your personal information, including the categories and sources of personal information we collect about you, the business or commercial purpose(s) for collecting, selling, or sharing your personal information, the categories of third parties to which your personal information is disclosed, and the specific pieces of personal information we have collected about you;

  • Update or correct your personal information or, where appropriate, to amend the personal details contained in your registered account with us;

  • Delete your personal information, subject to certain limitations;

  • Withdraw your consent with respect to personal information that is collected on the basis of your consent;

  • Opt out of having your personal information sold to or shared with third parties;

  • Limit the use and disclosure of sensitive personal information;

  • Not be discriminate against for exercising any of your rights. In particular, unless permitted by applicable law, we will not charge a different price for goods or services, including through granting discounts or other benefits, or imposing penalties; provide or suggest that you receive a different level or quality of goods or services; and 

  • Lodge a complaint with us or, as applicable, with a supervisory authority.

Marketing Communications

You have the right at any time to opt out of receiving our commercial electronic communications (e.g., marketing emails and SMS text messages).

If you have provided your contact information through a lead generation form, quiz, pop-up, or other sign-up experience and consented to receive marketing communications from Mizzen+Main, but no longer wish to do so, you may opt out at any time. To unsubscribe, follow the instructions included at the bottom of our email messages or respond to an SMS message with 'STOP'. You may also withdraw your consent by contacting us at info@mizzenandmain.com.

Please note that opting out of marketing communications does not affect your ability to receive transactional or service-related communications, such as order confirmations, shipping updates, or responses to customer service inquiries.

Please note that if you unsubscribe from or opt-out of our marketing communications, you will still receive order confirmation messages or other transactional information from us.

Exercising Your Privacy Rights and Choices

To exercise your privacy rights and choices please submit a request to us by completing our Privacy Web Form or by email at info@mizzenandmain.com. You may also reach us by calling our toll-free number at (877) 958-9626. 

Additionally, you may designate an authorized agent to make a request on your behalf.  Authorized agents will be required to provide proof of their authority to act on your behalf. 

If we are unable to verify your identity, we may be unable to fulfill your request.  Therefore, we may request or require additional information from you and/or to confirm an authorized agent’s representation of you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

When we run a sweepstakes, contest, promotion or survey, we may collect certain personal information from participants to enter them into the promotion or competition, and to deliver any prizes that the participant may win. This information includes contact information (such as name, address, age, date of birth, email address, telephone number) and any information provided by participants to claim and deliver prizes. We may combine this information with other information we have previously collected about you in order to carry out other purposes discussed in this Privacy Policy.

Children’s Privacy

The Online Services are not directed to children under the age of 16, and Mizzen+Main does not knowingly collect personal information from anyone under the age of 16.

Hosting and Security

Our store is hosted by an e-commerce company, which provides us with the e-commerce platform that allows us to sell our products and services to you. Your data is stored through their data storage, databases and general applications. 

We maintain commercially reasonable security measures designed to prevent unauthorized access, use, or disclosure of your personal information. However, no method of transmission over the Internet, nor any means of electronic or physical storage, is absolutely secure. Accordingly, we cannot guarantee the absolute security of your personal information.

Service Providers

Certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

Links to Other Websites or Services

Our Online Services may contain links to third-party websites or services not operated by us. We do not control these third-party websites or services and are not responsible for any information you may provide while on such websites or services. Cookies Policy

We may use cookies, web beacons (also known as "tracking pixels") and other tracking technologies to collect information about you when you interact with our Online Services or emails, including information about your browsing and purchasing behavior. We may combine this information with other information we collect about you and use it for various purposes, such as improving our websites and your online experience, understanding which areas and features of our sites are popular, counting visits, understanding marketing campaign effectiveness, tailoring our communications with you, determining whether an email has been opened and links within the email have been clicked and for other internal business purposes.
